Even Probation Can Have Life-Changing Consequences

What if I Receive Probation for a Sex Offense?

  • Mandatory 10 p.m. to 6 a.m. curfew
  • Prohibition from living within 1000 feet of a school, daycare center, park or playground (if the victim is under the age of 18)
  • Participation in and successful completion of a sex offender treatment program

Even if you receive probation in a sex crime case, you could be still be subject to sex offender registration.

Which Sex Crimes Are Subject to Sex Offender Registration?

While there are some exceptions, in Florida, sex offender registration typically is for life. Under the Jessica Lunsford Act, sexual offenders and predators must report in person to the sheriff office in country where they reside. Failure to report their current address is a third degree felony subject to incarceration.

What is the Jimmy Ryce Act?

Under the Jimmy Ryce Act, if you have been convicted sex crime and are sentenced to prison for a sex offense or any other offense, prior to your release from prison, the government may place you in a civil commitment indefinitely. If the government deems you a violent sexual predator, you must speak to an attorney experienced in this serious act. You may face civil commitment for life.

Can I Have Sex Offender Registration Removed?

There are a few narrow grounds that would allow you to remove the requirement for sex offender registration in Florida. One example is that if you were convicted of statutory rape (consensual sex with a minor), and there was a narrow difference between the ages of the accused and the victim, our lawyers can seek to have the requirement removed.
