What is Possession of Drug Paraphernalia?
Possession of drug paraphernalia is possession of anything that can be used to package, carry or consume drugs — a baggy, a pipe, a needle or a bong. Before a jury can convict you of possession of drug paraphernalia, the state has to prove that the item was used for the purpose of carrying, packaging or ingesting illegal drugs. Simply being in possession of a bong is not a crime. However, if there is drug residue on the bong, the state may be able to convict you.
Defenses in Drug Paraphernalia Possession Cases
The police need legal reasons to stop and search a person or their car for drugs. If the police violated your constitutional rights in the search and seizure, the evidence can be suppressed (excluded).
Not all search and seizure issues are clear cut. For example, many police officers will claim that they smelled marijuana after stopping a vehicle. A subsequent search may find a pipe that had been used to consume marijuana at some time. Our lawyers have been successful in challenging illegal search and seizure cases, often resulting in the charges getting dropped.
